GENERAL TERMS AND CONDITIONS FOR USE
OF THE E-COMMERCE PLATFORM www.plastic-sofia.com

I. ESSENCE

  1. These general terms and conditions are intended to regulate the relations between "Plastic Sofia" Ltd., with its registered office and address in Bulgaria, Sofia, postal code 1510, Poduyane district, Stefan Konsulov street No. 12, with EIC 130349076, represented by Manager Lyubomir Yonkov Nedkov, hereinafter referred to as "Seller", and the customers, hereinafter referred to as "Buyer(s)" or "User(s)", on the e-commerce platform "www.plastic-sofia.com", hereinafter referred to as the "Platform".

II. INFORMATION ABOUT THE SELLER

Information according to the Electronic Commerce Act and the Consumer Protection Act:

  1. "Plastic Sofia" Ltd. is a company with its registered office and address in Bulgaria, Sofia, postal code 1510, Poduyane district, Stefan Konsulov street No. 12, phone: +359/29455045, with EIC 130349076 and VAT identification number: BG130349076, email address: webadmin@plastic-sofia.com, website: http://www.plastic-sofia.com/. "Plastic Sofia" Ltd. is the personal data administrator, registered by the Personal Data Protection Commission in the "Register of Personal Data Administrators and the Registers Maintained by Them" with unique identification number: 107383.

  2. "Plastic Sofia" Ltd. is the administrator of the e-commerce platform: www.plastic-sofia.com.

  4. The Seller on the e-commerce platform is "Plastic Sofia" Ltd.

III. DEFINITIONS

  1. Seller – "Plastic Sofia" Ltd.

  2. Buyer (User) – any individual or legal entity that enters into a purchase agreement through the e-commerce platform of "Plastic Sofia" Ltd.

  3. E-commerce platform (the Platform) – represents the domain www.plastic-sofia.com, owned by "Plastic Sofia" Ltd.

  4. User Profile – created after registration by the User with an email address and password. The profile is a mandatory condition for the User to place an order. It contains information about the User and the history of their activities on the Platform, including but not limited to: orders, invoices, addresses, etc.

  5. My Products – section in the Profile that allows the User to create their preferred product list.

  6. Order – an electronic document created by the User through which they express their intent to purchase products from the Platform www.plastic-sofia.com.

  7. Product(s) – all products that can be subject to a purchase and sale agreement between the Buyer and the Seller through the Platform. All products offered by the Seller are for single use unless specified in their description available on the Platform that they are for multiple uses.

  8. Promotion, Campaign – any commercial action by the Seller aimed at promoting the Platform, trademarks, or certain products offered in limited quantities and within a specified period, unless otherwise stated in the commercial communication.

  9. Contract – the distance contract entered into between the Seller and the Buyer for the purchase of products through the Platform, an inseparable part of which are these general terms and conditions for the use of the Platform.

  10. Special Terms – clauses in the contract between the Seller and the Buyer or agreements reflected in the Seller’s invoice, containing deviations from these general terms and conditions.

  11. Content – all the information on the Platform www.plastic-sofia.com, which is accessible through an internet connection.

  12. Newsletter – an option for periodic notifications of products or promotions offered by the Seller, sent electronically via email.

  13. Description – all characteristics of the products as listed in their descriptions on the Platform.

  14. Comment – an evaluation or critical note regarding a product presented on the Platform.

  15. Inquiry – a form of communication with the Seller to request information regarding certain products.

  16. Party/Parties – the Seller and the Buyer are collectively referred to as the Parties, and individually as a Party.

IV. GENERAL PROVISIONS

  1. The general terms and conditions of "Plastic Sofia" Ltd. are binding for all Users of the Platform.

  2. These general terms and conditions can be unilaterally changed by "Plastic Sofia" Ltd. at any time. The Seller will notify all registered Users of the Platform within 7 days of such changes. The Parties agree that any amendments to these terms will take effect for the User after they are explicitly notified by the Seller, and if the User does not reject them within one month from receiving the notice. The User agrees that all declarations by the Seller regarding changes to these terms will be sent to the email address provided by the User during registration.

  3. By using the Platform, the User declares that they have read the general terms and conditions for its use and agree to comply with them unconditionally.

  4. In addition to the notification procedure in item 2 of this chapter, in the event of any changes to the general terms and conditions, "Plastic Sofia" Ltd. will inform the Users through an update on the Platform. Each User may at any time refer to the changes in the general terms and conditions.

  5. "Plastic Sofia" Ltd. makes serious efforts to maintain the accuracy of the information presented on the Platform. However, considering possible technical errors or omissions, "Plastic Sofia" Ltd. clarifies that the images of the products are illustrative, and the delivered products may differ from the images.

  6. Prices and descriptions of products may be changed at any time by the Seller.

  7. All products, including those on promotion/discount, are sold and delivered until stocks run out, even if not explicitly indicated on the Platform.

  8. The Platform may contain links to other websites. "Plastic Sofia" Ltd. is not responsible for websites it does not administer, nor for other information contained within them.

  9. By accepting the general terms, the User declares that they are over 18 years old. Persons under 18 years old are not allowed to use the Platform. If the Seller finds that a User does not meet this requirement, their profile may be deleted from the Platform without notice.

V. CHARACTERISTICS OF THE PLATFORM

  1. The Platform is an online store accessible at www.plastic-sofia.com, through which Users can enter into purchase and sale contracts and arrange the delivery of products offered on the Platform, including the following:

    1. Register and create a Profile to browse the Platform and use additional services to provide information;

    2. Make electronic declarations related to the conclusion or execution of contracts through the Platform’s interface;

    3. Make payments related to concluded contracts according to the available payment methods supported by the Platform;

    4. Receive information about new products offered by the Platform;

    5. Browse products, their characteristics, prices, and delivery terms;

    6. Be informed about rights arising from the law primarily through these general terms and conditions;

    7. The Seller delivers the products and guarantees the rights of the Buyers as provided by law, within the bounds of good faith, and according to the practice, consumer or commercial law criteria and conditions;

    8. Buyers enter into a purchase and sale agreement for the products offered on the Platform www.plastic-sofia.com;

    9. By the purchase agreement concluded with the Buyers, the Seller undertakes to deliver and transfer ownership of the specified product(s) to the Buyer;

    10. Buyers pay the Seller compensation for the delivered products in accordance with the terms specified on the Platform and these general terms and conditions. The compensation is equal to the price announced by the Seller on the Platform at www.plastic-sofia.com;

    11. The Seller delivers the products ordered by the Buyers within the timeframes and under the conditions defined by the Seller on the Platform at www.plastic-sofia.com and according to these general terms and conditions;

    12. Delivery costs are determined separately from the product price;

    13. The Parties agree that all declarations between them related to the conclusion and execution of the contract may be made electronically and via electronic declarations as per the Electronic Document and Electronic Signature Act and Article 11 of the Electronic Commerce Act;

    14. Electronic declarations made by the Users of the Platform are presumed to be made by the individuals listed in the data provided by the User during registration, if the User has entered the corresponding name and password for access;

    15. During registration, the User is obliged to provide accurate and up-to-date information and must promptly update any changed data.

VI. CONTRACT

  1. The Buyer expresses their intention to order and purchase a product via the Platform by making an Order electronically or by phone, which is registered either by the Buyer or by an employee of “Plastic Sofia” Ltd. on their behalf;

  2. The Seller provides technical means within the Platform to detect and correct errors in the entered information before the declaration to conclude the contract is made;

  3. "Plastic Sofia" Ltd. will send a notification to the Buyer electronically (via email) or by phone about the registration of their Order;

  4. The Seller reserves the right not to deliver the Order or part of it due to various objective reasons, including but not limited to stock shortages. In all cases, the User will be notified via email or phone, and the Seller is obliged to return the pre-paid amount (if payment was made before the product was delivered) for the undelivered part of the Order;

  5. The Seller is not liable for any damages incurred by the Buyer due to force majeure events or circumstances beyond the Seller's control;

  6. The contract for distance selling between the Seller and the Buyer is considered concluded when the Buyer receives a notification that their Order has been accepted. The declaration for the conclusion of the contract and confirmation of receipt are considered received when the addressees have access to them;

  7. The purchase and sale contract concluded between the Buyer and the Seller consists of these general terms and conditions and any potential additional agreements between the Seller and the Buyer;

  8. The contract is concluded in the Bulgarian language;

  9. The Seller delivers the products to the address provided by the Buyer and is not responsible if the Buyer provides incorrect or misleading data.

X. ORDER

  1. The Client can place orders on the Platform by adding desired products to the shopping cart;

  2. Adding products to the shopping cart without completing the order does not lead to the registration of the order or the automatic reservation of the products;

  3. By confirming the Order, "Plastic Sofia" Ltd. undertakes to deliver the corresponding products;

  4. The Buyer is obliged to provide accurate information at the time of sending the Order;

  5. The Seller has the right to cancel the Buyer’s Order and must inform the Buyer. Cancellation of the Order does not create liability or further obligation for either Party, and neither Party has the right to seek compensation for the cancellation in the following cases:

    • Non-acceptance of the transaction by the Buyer’s bank for online payments;

    • Execution of the financial transaction without the funds being credited to the Seller’s account;

    • Incomplete or incorrect data provided by the Buyer on the Platform.

XI. PRODUCTS WITHOUT THE RIGHT OF WITHDRAWAL

  1. The Client does not have the right to withdraw from the concluded contract in the following cases:

    • Delivery of products made to the User’s specifications or according to their individual requirements;

    • Delivery of products that, due to their nature, can deteriorate or have a short shelf life;

    • Delivery of sealed products that were unpacked after delivery and cannot be returned due to hygiene or health protection reasons.

XII. ADVERTISING

  1. After registering on the Platform of “Plastic Sofia” Ltd., the User can choose to receive the Newsletter (Email Subscription);

  2. The User can unsubscribe from receiving the Newsletter at any time by sending a message to the email address provided in the Newsletter or the addresses listed in Section II, Item 3 above.

    XIII. INVOICING – PAYMENT

    1. The prices of the products announced on the Platform are final and include VAT, as well as all other taxes and fees provided by the current Bulgarian legislation.

    2. For the convenience of the User, there is an option for the prices to be displayed with or without VAT, as well as the option to change the currency to euros (EUR). This is at the discretion of the User.

    3. The Buyer is obliged to provide all necessary information for issuing the invoice in accordance with the current Bulgarian legislation.

    4. The Seller will issue an invoice to the Buyer for the ordered and delivered products based on the information provided by the User.

    5. "Plastic Sofia" Ltd. issues an invoice for every payment made for an Order, through which the User has purchased a product.

    6. The Client will have a record of the invoices issued by the Seller in their Profile, which can be stored or archived at any time.

    7. The Buyer pays the price of a given product in one of the following ways:

      • Cash on delivery,

      • Bank transfer to the following bank account:

        • United Bulgarian Bank AD IBAN: BG19 UBBS 8155 1037 1394 08

    8. a) Due to the specifics of the unit price of the products offered by the Seller, when a larger quantity of a given product is ordered, there may be a price difference due to rounding according to a standard mechanism specified below.

    b) The prices to be paid are rounded to two decimal places. The rounding is done in the following way:

    • If the third digit after the decimal point is between 0 and 4, the second digit after the decimal point remains unchanged;

    • If the third digit after the decimal point is between 5 and 9, 1 is added to the second digit after the decimal point.

    XIV. DELIVERY

    1. The Seller is obligated to deliver the ordered and purchased products either by themselves or through a courier company to the address provided by the Buyer or to a courier office, depending on the Buyer’s choice.

    2. The Seller will ensure appropriate packaging of the products and the sending of accompanying documents. If by any chance the necessary document for the ordered product is not included in the shipment, the Buyer must contact "Plastic Sofia" Ltd. via email at webadmin@plastic-sofia.com, and "Plastic Sofia" Ltd. will do everything possible to provide it as quickly as possible.

    3. The Seller will provide free delivery for orders worth over 100 BGN within the city of Sofia.

    4. Products worth less than 100 BGN will be delivered by courier at the Buyer’s expense.

    5. For the convenience of Users, the Platform has an integrated shipping calculator.

    6. Deliveries outside the city of Sofia will be performed by courier at the Buyer’s expense.

    XV. TRANSFER OF OWNERSHIP

    1. Ownership of the products will be transferred from the Seller to the Buyer upon delivery of the products to the Buyer, after the Buyer has made the payment. The transfer of the product will be confirmed with the Buyer’s signature on the transport document provided by the courier.

    XVI. SUBMITTING COMPLAINTS AND CLAIMS

    1. The Buyer has the right to submit a complaint if the products do not conform to these general terms and conditions. The complaint can be submitted in electronic or written form and must include the Buyer’s details, including their email address, and a description of the violated terms.

    2. The address for submitting complaints in written form is: Bulgaria, Sofia, postal code 1510, Poduyane district, Stefan Konsulov street No. 12.

    3. The address for submitting complaints in electronic form: webadmin@plastic-sofia.com.

    4. The Seller's team will duly review the submitted complaints within 14 days from receipt and will respond to the email address provided by the Buyer.

    XVII. LIABILITY

    1. The Seller is not liable for any damages incurred by the Buyer resulting from force majeure events or those beyond the Seller’s control.

    2. Neither Party will be liable for non-fulfillment of their contractual obligations if such non-fulfillment is due to force majeure. A force majeure event is an unforeseeable event, beyond the control of the Parties, which cannot be avoided.

    XVIII. INFORMATION AND CONSENT

    The Buyer declares that they have been provided with information and are familiar with:

    1. The name and address, as well as all other identifying information of the Seller;

    2. All characteristics of the products provided by the Seller;

    3. The price of the products, including all taxes and fees;

    4. The payment method and other conditions for the provision of the products;

    5. The Buyer’s right to withdraw from the products;

    6. The conditions for purchasing the products;

    7. The conditions and duration of the warranty;

    8. Contact information for the Seller, including phone and email;

    9. The technical steps for concluding the contract and their legal significance;

    10. The technical means to detect and correct errors in entering information before making a declaration to conclude the contract.

    XIX. PERSONAL DATA PROTECTION

    1. The Seller takes measures to protect the personal data of the Users in accordance with the Personal Data Protection Act.

    2. The Seller adopts and publishes a Privacy Policy on their website, available at: www.plastic-sofia.com.

    3. At any time, the Seller has the right to require the User to authenticate and verify the accuracy of any information provided during registration.

    4. If, for any reason, the User has forgotten or lost their username and password, the Seller has the right to apply a Procedure for Lost or Forgotten Username and Password, available at www.plastic-sofia.com.

    XX. JURISDICTION

    This Contract is governed by Bulgarian legislation. Any disputes arising between the Seller and the Buyer will be resolved by mutual agreement, or if this is not possible, the disputes will be settled by the competent Bulgarian judicial authorities, unless the Parties have agreed otherwise.

    XXI. ALTERNATIVE DISPUTE RESOLUTION

    The authority for alternative dispute resolution under Article 181n, paragraph 1 of the Consumer Protection Act is the conciliatory commissions of the Consumer Protection Commission, located at: Sofia 1000, Slaveykov square No. 4A, website: www.kzp.bg.

    In accordance with Article 181n, paragraph 4 of the Consumer Protection Act, we inform you that for resolving any dispute related to an online sale, you can also use the Online Dispute Resolution Platform, accessible at the following link: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=BG.

    The provision in this section applies to individuals who meet the definition of a consumer according to §13, item 1 of the Additional Provisions of the Consumer Protection Act.

    FINAL PROVISION

    These general terms and conditions come into force for all Users on April 26, 2017.
